[01] What these terms coverThese terms apply to the use of pixeljuniper.com and, together with the written quote for each shoot, to the photography services of Pixel Juniper, a sole-proprietor studio at 5-9-9 Nishioizumi, Nerima, Tokyo 178-0065. Reading the site commits you to nothing. Booking a shoot means you have read and accepted these terms and the quote.
[02] Booking and confirmationA booking exists when we have confirmed a date in writing and, for brand, editorial and event work, when the deposit has arrived. Portrait and family sessions do not require a deposit; a confirmed date in writing is enough. Quotes are valid for thirty days. They include the pre-shoot call, the session time stated, the proof gallery and the number of final edited files listed. Additional edited files, extra hours and travel beyond Tokyo's 23 wards are quoted separately before the shoot, never afterwards.
[03] Rescheduling and cancellationOne reschedule is free for any session, weather-related or not, as long as we hear from you at least 48 hours before the start time. A second reschedule, or a cancellation with less than 48 hours' notice, forfeits the deposit or, for sessions without a deposit, incurs a fee of 30% of the quoted price. If we have to cancel — illness, equipment failure, a location that becomes unavailable — you get a new date or a full refund of anything paid, your choice.
[04] PaymentInvoices are issued on delivery of the final files and are payable within fourteen days by bank transfer or card link. Prices on this site are shown in yen and include consumption tax unless marked otherwise. Late invoices attract statutory interest under Japanese law and, more practically, a reminder email from Callum.
[05] Delivery and the proof galleryYou receive a password-protected proof gallery within three working days of the shoot for portrait and family work, and within five working days for brand and event work. You choose your selections; we edit those. Final files are delivered as high-resolution JPEGs through the same gallery within ten working days of your selection. Proof galleries close ninety days after final delivery, so download what you want to keep.
[06] Licence to use the photographsCopyright in every photograph stays with Pixel Juniper, as Japanese copyright law provides for commissioned photography. In return for payment you receive a licence, set out in a one-page document delivered with the files, to use the images for your personal purposes or for the business purposes described in the quote — website, social media, print collateral, press kits — worldwide and without time limit. The licence does not cover selling the images, licensing them to third parties or using them in paid advertising campaigns unless the quote says so. Editing, cropping and colour-grading for layout are fine; passing off the images as someone else's work is not.
[07] Portfolio use and publicityWe may show images from a shoot in our own portfolio, on this website and on our social media only where you have ticked the portfolio box in the licence document or agreed by email. Images of children are never used without a parent's written consent. You can withdraw permission at any time and we will remove the images within five working days.
[08] Your responsibilities on the dayYou are responsible for obtaining permission to photograph at private locations you choose, for arranging model releases from your own staff or participants when you commission a brand or event shoot, and for telling us about anything at the location that could be unsafe. We will always say if a shot cannot be done safely, and the answer is then no.
[09] Content of this websiteTexts and photographs on pixeljuniper.com belong to Pixel Juniper or are used with the subject's consent. You may link to any page. You may not copy the photographs for any use other than a personal, non-commercial look at our work. Prices, packages and availability on the site are kept accurate but can change before this page does; the quote is the document that binds us.
[10] LiabilityOur liability for any shoot is limited to the amount paid for that shoot. We are not responsible for losses caused by weather, venue restrictions, the behaviour of people we did not bring, or files you delete after we have delivered them and the gallery has closed. Nothing here limits liability that cannot be limited under Japanese law, and nothing here reduces the consumer protections you have as an individual client under the Consumer Contract Act.
[11] Changes and governing lawWe revise these terms occasionally; the version on this page is the one in force, and a booking is governed by the version current on the day it was confirmed. These terms are governed by the laws of Japan. Disputes that cannot be settled by talking go to the Tokyo District Court as the court of first instance with exclusive jurisdiction.
